Please READ carefully. By purchasing, enrolling in, or accessing The Organized Living Society (the “Membership”), these Terms and Conditions (the “Agreement”) are entered into by At Home With Mackenzie, LLC (“Company,” “we,” “us,” or “our”) and you (“Member,” “participant,” or “you”). The Company and you may be referred to collectively as the “Parties.”
1. Membership Description
The Company agrees to provide access to The Organized Living Society, an annual course-based membership program designed to help busy, working moms with kids ages 5-14 create calm, organized, and functional homes through simple, realistic systems and ongoing support. The Membership includes the following:
Course Content
The Membership includes access to a 7-module course covering home organization mindset and foundation, decluttering, home systems and routines, paper clutter management, digital organization, family involvement, and long-term maintenance. Each module includes pre-recorded video lessons, downloadable worksheets, checklists, guidebooks, and templates, including a Notion Home Hub Template. All course content is accessible immediately upon joining and remains available for as long as the Member maintains an active Membership.
Live Q&A Calls
Members have access to monthly live Q&A calls hosted by the instructor via Zoom, where Members may submit questions in advance or attend live to receive real-time support and guidance. During the initial seed launch period, weekly live Q&A calls will be held for each of the 7 modules (8 calls total) before transitioning to the monthly schedule. Members who are unable to attend live may submit questions in advance and access call replays in the Member portal.
Monthly Live Workshops
Members have access to monthly live workshop calls hosted by the instructor via Zoom. Each workshop is themed around a specific area of the home or a seasonal organizing challenge, and is designed to be a hands-on working session where Members can make real progress alongside the instructor and fellow Members. Workshop replays and any associated resources will be made available in the Member portal following each call.
Private Community
Members have access to a private community hosted inside Kajabi, where the course content is also housed. The community is a space for Members to share wins, ask questions between calls, post before and after photos, and connect with and support one another throughout the program.
Access Period
Your Membership grants access to all content, calls, and community for the duration of your current annual membership term. As long as your Membership remains active and in good standing, you will continue to have access to all content, including any new content added to the Membership after your original purchase date.
As a condition of participation, you agree to be bound by and to abide by all policies described in this Agreement, including those incorporated by reference, such as our Website Terms of Use, Privacy Policy, and Disclaimer.
2. Eligibility
The Membership is intended for individuals 18 years of age or older. By enrolling, you represent that you are at least 18. The Membership is designed for personal and household use and does not constitute clinical, medical, legal, or financial advice.
3. Company Terms Incorporated by Reference
The Company’s Website Terms of Use, Privacy Policy, and Disclaimer are incorporated by reference into this Agreement and apply to your participation in the Membership. In the event of a conflict between those documents and this Agreement, this Agreement controls for Membership sales and participation.
4. Fees, Payment, and Pricing
In consideration for access to the Membership, you agree to pay the applicable annual membership fee as displayed on the checkout page at the time of your purchase. All prices are in USD. Sales tax or VAT may apply based on your location and will be displayed at checkout when applicable.
Founding Member Pricing
Members who join during the founding member seed launch period will be charged $497 USD annually. This founding member rate is locked in for as long as the Member maintains a continuous, active Membership without interruption. If a founding member cancels their Membership and later rejoins, they will be subject to the then-current membership price at the time of rejoining and will no longer be eligible for the founding member rate.
Standard Pricing
Following the close of the founding member seed launch, the standard annual membership price will increase to $697 USD annually and may continue to increase over time as the Membership grows. Members who join at the standard price or any future price point are not eligible for founding member pricing.
No Monthly or Quarterly Payment Options
The Organized Living Society is offered on an annual basis only. Monthly and quarterly membership pricing options are not available at this time. However, third-party buy-now-pay-later services, including Klarna and AfterPay, may be available as payment options at checkout and are subject to their own separate terms, conditions, and approval processes. The Company is not responsible for the terms, fees, or decisions of third-party payment services.
Payment Authorization
By purchasing, you authorize the Company and its payment processors to charge your selected payment method for the full annual membership fee at checkout and upon each subsequent annual renewal. If your payment method on file is declined at the time of renewal, your access to the Membership may be suspended until payment is successfully processed.
No Circumvention
Except as permitted under the Refund Policy in Section 5, you may not cancel or avoid your payment obligations for the current membership term. Initiating a chargeback outside of the Refund Policy is a violation of this Agreement and may result in immediate termination of your Membership without refund.
5. Refund Policy
The Company wants you to feel confident in your investment in The Organized Living Society. Because the Membership provides immediate access to all course content upon joining, including all 7 modules, worksheets, checklists, guidebooks, and templates, the following refund policy applies.
7-Day Money-Back Guarantee
You may request a full refund within 7 days of the date the program officially begins for your cohort (“Refund Period”). The program start date will be communicated to Members upon joining. To request a refund, email support@athomewithmackenzie.com within the Refund Period with your full name, purchase email address, and order number.
No Pro-Rated Refunds
Because the bulk of the Membership’s value is delivered through the course content, which is made available in full upon joining, no pro-rated refunds will be issued for early cancellation after the Refund Period has closed. If you choose to cancel your Membership after the Refund Period, you will retain access to the Membership for the remainder of your current paid annual term, after which your Membership will not renew.
What Happens After a Refund
If a refund is granted, your Membership license terminates immediately. You must cease all use of Membership materials and delete or destroy any copies of downloaded content, including videos, audio files, PDFs, templates, checklists, worksheets, and any community-only resources. No refunds will be granted after the Refund Period has closed, regardless of the reason for cancellation.
The Membership does not include any physical products; therefore, no return shipping applies.
6. Membership Renewal & Cancellation
Annual Renewal
Your Membership will automatically renew on an annual basis at your applicable membership rate unless you cancel prior to your renewal date. You will receive a renewal reminder via email to the address on file before your renewal date. It is your responsibility to ensure your contact and payment information remains current.
Cancellation
You may cancel your Membership at any time by contacting support@athomewithmackenzie.com. Cancellation will take effect at the end of your current paid annual term. You will retain access to all Membership content, calls, and community through the end of your paid term. No pro-rated refunds will be issued for the unused portion of your annual term following the close of the Refund Period.
Founding Member Rate and Continuous Membership
Founding members who joined during the seed launch at the $497 annual rate will retain that rate for all future renewals as long as their Membership remains continuous and uninterrupted. A lapse in Membership for any reason, including voluntary cancellation, non-payment, or termination due to a violation of this Agreement, will result in the permanent forfeiture of the founding member rate. Rejoining after a lapse will be subject to the then-current membership price.
7. Community Guidelines, Your Conduct, & Confidentiality
The Organized Living Society includes access to a private community hosted on Kajabi. By participating in the community, you agree to the following:
- Treat all Members and the instructor respectfully at all times. Harassment, hate speech, discriminatory remarks, defamation, spamming, and unsolicited promotion of your own products, services, or groups are strictly prohibited. The Membership community is a pitch-free zone.
- Do not share private Member information outside the community without the express written permission of the Member whose information is being shared.
- You are solely responsible for the content of your posts and any liability arising from them. The Company may moderate, remove, or restrict content or accounts at its discretion and has no obligation to monitor all content posted in the community.
- To protect Member privacy, you may not use AI tools or any other recording or transcription technology to capture live sessions that include other Members without the express written consent of the Company.
Violation of these community guidelines may result in removal from the community and/or termination of Membership access without refund.
8. Login Credentials & Account Security
You must keep your Membership login credentials confidential and may not share access to your account with any other person. Each Membership is valid for one individual only. The Company may disable accounts it reasonably believes have been compromised, shared, or created using false or inaccurate information, without refund.
9. No Guarantees; Results Disclaimer
The Organized Living Society is educational and informational in nature. The Company does not promise or guarantee any specific results, including but not limited to a decluttered home by a specific date, reduced stress, a particular level of home organization, or any other outcome. Your results will depend on many individual factors, including but not limited to your personal effort, available time, family participation, consistency, and individual circumstances.
Nothing contained in the Membership, including course content, live calls, workshops, community posts, or any other materials, constitutes medical, psychological, therapeutic, legal, financial, or professional advice of any kind. You are solely responsible for your decisions and actions, and you should always consult appropriate licensed professionals where needed.
10. Intellectual Property; Limited License
All Membership content, including but not limited to videos, audio recordings, written materials, PDFs, templates, checklists, worksheets, guidebooks, frameworks, graphics, and all derivatives thereof, are owned by the Company and/or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.
Upon joining the Membership, the Company grants you a limited, revocable, non-transferable license to access and use the Membership content for your own personal, non-commercial household use only. This license does not permit you to do any of the following:
- Share, sell, sublicense, reproduce, distribute, upload, or otherwise make Membership materials available to any third party, including but not limited to friends, family members, or clients
- Upload or store Membership materials in any database, platform, or tool, including AI or large language model training sets, where they could be accessed, indexed, or replicated by others or by artificial intelligence technologies
- Use Membership content for any commercial purpose
The Company reserves the right to revoke your license immediately and without refund if you are found to be in violation of these terms.
Liquidated Damages
Unauthorized use or distribution of Membership materials will cause harm that is difficult to quantify. You agree that in the event of such unauthorized use or distribution, you will pay five (5) times the total fees you paid for your Membership, or $5,000 USD minimum if no fees were paid, as liquidated damages, in addition to any other remedies available to the Company at law or in equity. This is an agreed-upon damages amount and is not intended as a penalty.
11. Testimonials; Media Release
By posting or submitting questions, comments, posts, images, before and after photos, or other content in the Membership portal or community, you represent that you own the content submitted and grant the Company a worldwide, perpetual, royalty-free, non-exclusive license to use, reproduce, modify, display, distribute, and create derivative works from your submissions for Membership-related and marketing purposes. You consent to the use of your name, likeness, and voice in connection with your submissions, in accordance with applicable law.
12. Call Recordings
Live Q&A calls and monthly workshop calls may be recorded by the Company for the purpose of providing replays to Members who are unable to attend live. By participating in any live call, you consent to being recorded for these Membership-related purposes. Recordings are made available to active Members only and may not be shared, distributed, published, or otherwise disseminated outside the Membership by any Member.
13. Force Majeure
The Company is not liable for any delays or failures in delivering Membership content, live calls, or other Membership benefits caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, labor disputes, power or internet outages, third-party platform outages, or governmental actions. In such events, the Company may adjust delivery schedules or make reasonable substitutions or accommodations without liability.
14. Disclaimers; Limitation of Liability
The Membership and all related materials and services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, the Company disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the maximum extent permitted by applicable law, the Company is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your participation in or use of the Membership. The Company’s total liability for any claim arising out of or related to this Agreement shall not exceed the total amount you paid for your current annual Membership term.
If you are dissatisfied with the Membership for any reason, your sole remedy is to discontinue use, subject to the Refund Policy described in Section 5.
15. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its owners, officers, employees, contractors, agents, successors, and assigns from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to (i) your participation in or use of the Membership; (ii) your violation of this Agreement; or (iii) your violation of any rights of a third party.
16. Modifications to the Membership and this Agreement
The Company reserves the right to modify, update, or discontinue any aspect of the Membership, including course content, call schedules, community features, and pricing for future membership terms, at any time. The Company also reserves the right to modify this Agreement at any time. Updates to this Agreement will be posted in the Member portal or on the Company’s website and will apply prospectively. Material changes that affect current Members will be communicated via the email address on file.
17. Termination
The Company may terminate or suspend your access to the Membership, community, or any live calls without refund if you breach this Agreement, disrupt the Membership experience for other Members, or engage in conduct the Company deems harmful, inappropriate, or inconsistent with the spirit of the community. Upon termination, your license to access and use Membership materials ends immediately. Sections of this Agreement that are intended to survive termination, including but not limited to Sections 10 (Intellectual Property), 14 (Disclaimers and Limitation of Liability), 15 (Indemnification), and 18 (Governing Law and Arbitration), shall survive.
If you cancel your Membership voluntarily after the Refund Period has closed, no refund will be provided for the unused portion of your annual term, and any founding member rate previously held will be permanently forfeited.
18. Governing Law; Arbitration; Class Action Waiver
This Agreement is governed by the laws of the State of Ohio, without regard to its conflict-of-law principles.
Except for claims seeking injunctive or equitable relief for intellectual property misuse or confidentiality breaches, any dispute, claim, or controversy arising out of or relating to this Agreement or the Membership shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Columbus, Ohio, or by video conference if agreed to by both Parties. The arbitrator shall issue a written, reasoned award. Each party shall bear its own attorneys’ fees and costs, except that the prevailing party’s fees and costs may be awarded as permitted by applicable law.
CLASS ACTION WAIVER: To the fullest extent permitted by applicable law, the Parties waive any right to bring or participate in any class, collective, or representative action. All disputes shall be arbitrated on an individual basis only.
19. International Members
The Membership is controlled and operated from the United States. Access to or use of the Membership may be restricted or unlawful in certain jurisdictions. You are solely responsible for compliance with the laws of your local jurisdiction.
20. Assignment
You may not assign your rights or obligations under this Agreement to any other person without the prior written consent of the Company. Your Membership is personal to you and non-transferable. The Company may assign this Agreement to a successor in interest in connection with a merger, acquisition, or sale of assets.
21. Severability; Entire Agreement
If any provision of this Agreement is found to be unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be replaced by a valid provision that most closely reflects the original intent of the Parties. This Agreement, together with any documents incorporated by reference, constitutes the entire agreement between the Parties with respect to the Membership and supersedes all prior or contemporaneous communications, representations, or agreements, whether written or oral.
